Jury Awards A Cancer Patient $72.5 Million In A New York Personal Injury Case Against The MTA
On February 22, 2024, a New York County jury awarded a plaintiff, who was left partially paralyzed after being struck by a New York City bus a $72.5 Million jury award.
On March 6, 2017, the plaintiff, then 61, was crossing East Houston Street when an M14 bus making a right turn from Avenue D slammed into the plaintiff. At the time of the incident, the plaintiff was going to visit her mother. The victim was pinned under the bus for about 20 minutes. The plaintiff never lost consciousness. The MTA bus driver was arrested and charged with failing to yield to a pedestrian.
As a result of the accident, the plaintiff sustained a crushed pelvis, significant nerve damage to her left leg and injuries so bad on the right leg she’s had an open wound for years. As a result of the accident, the plaintiff was left partially paralyzed.
The trial lasted for 30 days. The jury deliberated for three hours before issuing an award in favor of the plaintiff. The New York County jury awarded plaintiff $25 million for past pain and suffering, $32 million for future pain and suffering, and $8.5 million for future medical services. The jury also awarded the plaintiff’s husband $7 million for the past and future loss of services and companionship with his wife.
